Man killed in construction accident involving bulldozer in St. Pete

Justin H. Smith, of Dade City, was dead at the scene, St. Petersburg police reported.

The accident occurred at about 10 a.m. at 10980 Oak St. N.E., in the city’s Gateway area. Police said the bulldozer’s driver, 37-year-old Albert Kimbell, did not see Smith.

Kimbell, who worked for Central Site Development, was not injured but was not feeling well so authorities took him to Tampa General Hospital for precautionary reasons.

About 20 workers were on the site when the accident happened, including Smith’s brother, police said. “They were all pretty upset,” police spokeswoman Yolanda Fernandez said.

Marcie Mendez, who has lived across from the development for 27 years, said she heard screaming from the construction area Wednesday morning through her open windows. She went outside to see what was going on and saw emergency response crews pull into the area.

She said construction has been going on for six to seven weeks.

Smith, an employee with API Services for three months, was wearing a protective hat, work boots and a reflective vest, police said.

Police said no criminal charges will be filed.

The federal Occupational Safety and Health Administration plans to investigate, police said.
