ORLANDO — A University of Central Florida student from Hillsborough County and a fellow fraternity member face charges after they were accused of raping a woman at a party.
That fraternity has since been placed on interim suspension.
Orange County Sheriff’s deputies arrested 20-year-old David Anthony Kirk, of Wimauma, and 26-year-old Jack Ryan Smith, of Winter Springs, on Saturday. On Tuesday, the university accused Alpha Tau Omega fraternity of disruptive and alcohol-related conduct and suspended the fraternity.
This is the fraternity’s second suspension since July, when another woman reported being raped during a party.
According to the arrest report, the woman attended a Friday night party at what was described as a "party home" for the fraternity.
In a statement, the national fraternity said it supports the woman. The statement said the party wasn’t a fraternity event.
The party happened near campus. The victim is described as only remembering snapshots of the night, according to the Orlando Sentinel. She said she remembers waking up in a bedroom while Smith was raping her, taking turns with Kirk, according to the Sentinel.
The woman was sent to Florida Hospital East Orlando the next day.
Smith bonded out of jail. Kirk, who was expelled from the UCF chapter of the fraternity in January, remains in jail. Attorneys aren’t listed on jail records.
ATO has been reprimanded many times in the last five years. In 2012, the fraternity was suspended over a hazing incident where members beat a pledge, according to the Sentinel.
