Polk Detention Deputy Accused Of Sex With Inmate
TAMPA - A Polk County detention deputy was arrested today after an investigation revealed he had sex with an inmate in a staff bathroom at the Central County Jail, Polk County deputies say. Donald Kurns Jr., 40, has resigned - effective immediately. Donald Kurns Jr.Kurns, a detention deputy since March 1993, most recently was assigned to the jail's transportation unit. The inmate, whose identity was not released by Polk deputies, has been transferred to another county's jail. When the incident occurred, she was on "trusty" status. The inmate didn't want to have sex with Kurns but went along with it because he was an officer and she wanted to keep her trusty status, an affidavit states. Trusty status allows inmates to be released from jail earlier than the full sentence, a sheriff's office release states. "During a post-Miranda interview, Kurns admitted to the sexual intercourse between him and the inmate and described it as consensual," according to the release. Kurns was booked into the Polk County Jail. He was charged with sexual misconduct between detention employees and inmates. He also was charged with sexual battery on a victim over 12 years of age. Regardless of whether the sex was consensual, the charge would be sexual battery because detention deputies have control over inmates, the sheriff's office release states.
